Approvals and Measurementsالمادة الرابعة: الاعتمادات والمقاسات

Measurements shall be confirmed after a site survey where required. The Client shall approve drawings, dimensions, materials, and colors before manufacturing, and written or electronic approval shall be final. The First Party shall not be liable for discrepancies arising from Client-supplied information without a site survey. Minor natural variations in wood and fabrics shall not be defects.

تعتمد المقاسات بعد الرفع الميداني عند الحاجة. ويلتزم العميل باعتماد الرسومات والمقاسات والخامات والألوان قبل التصنيع، وتعد الموافقة الخطية أو الإلكترونية نهائية. ولا يتحمل الطرف الأول اختلافاً ناتجاً عن معلومات قدمها العميل دون رفع ميداني. ولا تعد الاختلافات الطبيعية البسيطة في الخشب والأقمشة عيوباً.

05Completion Periodالمادة الخامسة: مدة التنفيذ

Estimated completion period: as agreed in the contract, commencing after signing, receipt of the first payment, approvals, and site readiness. Official holidays and delays beyond the First Party’s reasonable control shall be excluded.

مدة التنفيذ التقديرية: حسب الاتفاق في العقد، وتبدأ بعد توقيع العقد وسداد الدفعة الأولى واعتماد الرسومات والخامات والألوان وجاهزية الموقع. ولا تدخل الإجازات الرسمية أو التأخيرات الخارجة عن إرادة الطرف الأول ضمن المدة.

06Variations and Additional Worksالمادة السادسة: التعديلات والأعمال الإضافية

Any post-approval change shall be assessed for feasibility, cost, and time, and shall only be carried out under an approved written or electronic variation order. The Client shall bear the cost of prior materials or work that cannot be reused.

يخضع أي تعديل بعد الاعتماد لدراسة التكلفة والمدة وإمكانية التنفيذ، ولا ينفذ إلا بأمر تغييري مكتوب أو إلكتروني معتمد. ويتحمل العميل تكلفة المواد أو الأعمال السابقة التي يتعذر استخدامها.

Site Readiness, Delivery and Installationالمادة السابعة: جاهزية الموقع والتوريد والتركيب

The Client shall prepare the site, secure access, complete relevant works, and provide power, lighting, water and electrical connection points, and permits. The First Party’s responsibility is limited to preparing its products for connection to those points unless the Schedule expressly states otherwise. Installation may be rescheduled if the site is not ready, and storage, re-delivery, or lifting costs may be charged. The Client shall disclose concealed utilities.

يلتزم العميل بتجهيز الموقع وتأمين الدخول واستكمال الأعمال المؤثرة في التركيب وتوفير الكهرباء والإنارة ونقاط الكهرباء والمياه والتصاريح. وتقتصر مسؤولية الطرف الأول على تجهيز منتجاته للربط بهذه النقاط ما لم ينص الجدول صراحة على غير ذلك. ويعاد جدولة التركيب عند عدم الجاهزية، وقد تحتسب تكاليف التخزين أو إعادة التوريد أو معدات الرفع. وعلى العميل كشف التمديدات المخفية.

08Inspection and Handoverالمادة الثامنة: الفحص والاستلام

The Client shall inspect and sign the handover report. Visible observations shall be submitted within the period agreed in the contract. The works shall be deemed accepted upon signature, use, expiry of the observation period without objection, or failure to attend handover. Warranty rights remain unaffected.

يفحص العميل الأعمال ويوقع محضر الاستلام، وتقدم الملاحظات الظاهرة خلال حسب الاتفاق في العقد. وتعد الأعمال مستلمة بالتوقيع أو الاستخدام أو انقضاء المدة دون اعتراض أو عدم حضور موعد الاستلام. ولا يمنع ذلك المطالبة بعيوب الضمان.

09Warrantyالمادة التاسعة: الضمان

Warranty period: as agreed in the contract, from handover. It covers manufacturing and installation defects attributable to the First Party and excludes misuse, moisture, leakage, fire, insects, excessive loads, normal wear, Client-supplied materials, third-party work, unauthorized alteration, and site defects.

مدة الضمان: حسب الاتفاق في العقد من تاريخ الاستلام. ويشمل عيوب التصنيع والتركيب المنسوبة للطرف الأول، ولا يشمل سوء الاستخدام أو الرطوبة أو التسرب أو الحريق أو الحشرات أو الأحمال الزائدة أو الاستهلاك الطبيعي أو مواد العميل أو أعمال الغير أو التعديل غير المعتمد أو عيوب الموقع.
